1. Acceptance of Terms
By downloading, accessing, or using Gwhen ("the App") or visiting gwhen.app ("the Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App or Site. Gwhen is operated by Pizza Friday Protocol LLC ("we," "us," or "our"), a Delaware limited liability company. You can learn more about us at pfplabs.ai.
2. Description of Service
Gwhen interprets weather forecast data to suggest favorable time windows for outdoor activities and other plans. We may also offer optional calendar integrations to help you find openings that already fit your schedule. Recommendations are generated from third-party forecast data and are provided for informational purposes only. We do not guarantee that any recommended window will be safe, comfortable, or free from weather-related risk.
3. Accounts and Eligibility
You must be at least 13 years old to use Gwhen. If you are under 18, you may only use the App under the supervision of a parent or legal guardian. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.
4. Subscriptions and Billing
Gwhen may offer a free tier and optional paid subscriptions or features ("Pro"). All payments and subscription management are processed through Apple's App Store In-App Purchase system. By subscribing, you agree to Apple's applicable terms and privacy practices. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period through your Apple ID settings. We do not process or store your payment information.
5. Privacy
Your privacy matters to us. Our Privacy Policy explains what information we collect, how we use it, and your rights. By using Gwhen, you consent to the practices described in the Privacy Policy.
6. Acceptable Use
You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the App; (b) use the App to violate any law or regulation; (c) interfere with or disrupt our servers or networks; (d) scrape, crawl, or automate access to the Site or App in a way that impairs performance; or (e) sublicense, resell, or commercially exploit Gwhen without our written consent.
7. Intellectual Property
All content, branding, code, designs, and other materials in the App and Site are owned by Pizza Friday Protocol LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
8. Disclaimers
Gwhen is provided "as is" and "as available" without warranties of any kind, either express or implied. Weather forecasts are inherently uncertain. We are not responsible for decisions you make based on our recommendations, including decisions about outdoor activities, travel, health, or safety. Always use your own judgment and consult authoritative local sources when conditions matter.
9. Limitation of Liability
To the fullest extent permitted by law, Pizza Friday Protocol LLC and its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of the App or Site. Our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim, or $100 if you have not made any payment.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by updating the effective date above. Your continued use of Gwhen after such changes constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in Delaware.
